Terms of service

By creating a Propietta account, listing a property or using any part of the service, you accept these Terms. If you disagree with any clause, do not use the service. These Terms may be updated; if we do, we will notify by email and the new version will apply 15 days after notice. To use Propietta you must be of legal age under your country's law and have legal capacity to enter contracts.

You may use Propietta to: list properties you own or have explicit owner authorization for; generate printable QR signs; manage prospects reaching your public listing; use the AI features included in your plan. You may not use Propietta to: list properties without authorization; publish false or misleading info; run automated scraping against other users' listings; attempt to reverse-engineer or extract our code or AI prompts.

You own the content you publish (photos, descriptions, property data). By publishing it you grant us a limited, non-exclusive, royalty-free license to process, store, show on the public listing and use it in the AI features you enable (photo enhancement, description generation, chatbot). You are responsible for the content being truthful and for having the rights to publish it. If a third party claims rights to your content, we will cooperate but will not assume responsibility on your behalf.

The platform, code, designs, brand, AI prompts and any derived software are Propietta's property. Your subscription grants you the right to use the service, not to copy, redistribute or modify it.

Propietta includes AI features (prospect-qualifying chatbot, photo enhancement and description generation). These features use third-party models (currently Google Gemini) and their output may contain errors or inaccuracies. You must review the output before publishing. We comply with disclosure regulations for AI-generated or modified content: • California and New York (US): every AI-modified photo carries a visible "Enhanced with AI" watermark stamped post-processing. It cannot be disabled. • EU AI Act (in force 2026): the labeling of AI-modified content applies to all service users, regardless of location. • Colombia and LATAM: no specific regulation yet, but we apply the stricter standard preemptively. AI only adds "light staging" (small objects on existing surfaces). It cannot add large furniture where none existed, simulate renovations or change the property's structure.

Paddle is the Merchant of Record for all Propietta transactions. That means Paddle processes the payment, issues the invoice, handles taxes (VAT, sales tax) and manages chargeback disputes. Propietta receives the net after Paddle fees. By subscribing you also accept Paddle's terms, available at paddle.com. Subscriptions renew automatically until canceled. You may cancel anytime from your dashboard; you keep access until the end of the billed cycle.

We may suspend or terminate your account if: (a) you breach these Terms; (b) a payment fails and is not remedied within 30 days; (c) you publish illegal, fraudulent content or content violating third-party rights; (d) a legal order requires it. You may terminate your account anytime from the dashboard. After closure we retain your data for 6 months (tax compliance) and then delete it, unless a legal obligation requires longer retention.

Propietta is offered "as is". We don't guarantee 100% uptime, though we aim for a high SLA. We are not responsible for: indirect damages, lost profit or opportunity; errors or inaccuracies in AI output you published without reviewing; consequences of commercial decisions based on platform information. Our maximum liability, in any case, is limited to the amount paid for your subscription in the last 12 months.

These Terms are governed by the laws of the Republic of Colombia. Any dispute will be resolved by the competent courts of Bogotá D.C., Colombia, unless a local consumer law of the user requires a different jurisdiction. If you are a user outside Colombia, additional protections from your jurisdiction may apply and prevail over this clause.

We may update these Terms to reflect legal, regulatory or service changes. We will notify by email to the registered address at least 15 days in advance. If you keep using the service after that date, you accept the updated version. If you disagree, you may cancel your subscription before changes take effect.
